These Terms of Service ("Terms") govern your access to and use of the Meera Capsule store and website at meeracapsule.com (and its variants meeracapsule.ca, meeracapsule.us), and any related Services. The Services are operated by Meera Capsule Inc., a Canadian corporation ("Meera Capsule," "we," "us," or "our").

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction (whichever is older), to make a purchase or create an account on the Services. By placing an order, you represent that you meet this age requirement and that the payment method you provide is yours, or that you have been authorized to use it by its holder.

Account Registration

You may browse the Services without creating an account, but certain features (such as order history, saved addresses, or wishlists) require registration. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us immediately at team@meeracapsule.com if you suspect any unauthorized use.

Orders, Pricing, and Availability

All prices are listed in Canadian Dollars (CAD) on the Canadian storefront and U.S. Dollars (USD) on the U.S. storefront. Prices, product descriptions, and availability may change without notice. We reserve the right to:

Limit quantities sold to any customer or order
Refuse or cancel orders for any reason, including suspected fraud, pricing errors, or stock unavailability
Correct any errors in pricing, product descriptions, or other information on the Services

If we cancel an order after payment has been processed, we will issue a full refund to the original payment method.

Shipping and Delivery

Shipping terms, rates, and delivery times are described in our Shipping Policy. Risk of loss and title for products pass to you upon delivery to the carrier.

Returns, Refunds, and Warranty

Our return, refund, and warranty terms are set out in our Refund Policy, which is incorporated into these Terms by reference. Please review it carefully — particularly the differences between our Canadian and U.S. policies.

Intellectual Property

All content on the Services — including the Meera Capsule name and logo, product photographs, written content, illustrations, packaging design, and the overall look and feel — is owned by Meera Capsule Inc. or our licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works of any content on the Services without our prior written consent, except as expressly permitted by these Terms or applicable law (such as personal, non-commercial use).

User Content and Reviews

You may submit reviews, photos, comments, social media tags, or other content related to our products ("User Content"). When you submit User Content or tag us on a third-party platform (such as Instagram or TikTok), you grant Meera Capsule a non-exclusive, worldwide, royalty-free, perpetual, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display that User Content in any media, including for marketing, advertising, and promotional purposes — with attribution to your social handle where reasonably possible.

You represent that you own or have the rights to submit your User Content, that it does not violate the rights of any third party, and that it is accurate and not misleading. We reserve the right to remove or refuse to display any User Content at our discretion.

Prohibited Uses

You agree not to use the Services to:

Violate any applicable law, regulation, or third-party right
Engage in fraudulent activity, including chargebacks made in bad faith
Resell, redistribute, or commercially exploit our products without our prior written authorization
Scrape, crawl, harvest, or otherwise extract data from the Services using automated tools without permission
Reverse-engineer, decompile, or attempt to circumvent any security feature of the Services
Upload viruses, malware, or other malicious code
Harass, abuse, threaten, or impersonate any person, including our team and other customers
Interfere with the operation of the Services or attempt to gain unauthorized access to our systems

Account Termination

We may suspend or terminate your account, refuse future orders, or restrict your access to the Services, at our sole discretion, if you:

Violate these Terms or our other policies
Engage in fraudulent, abusive, or harmful activity
Submit excessive or bad-faith chargebacks or returns
Have not used your account for an extended period (typically 5 or more years)

Disclaimers

The Services and all products are provided "as is" and "as available", without warranties of any kind, whether express or implied, except as expressly set out in our Refund Policy or required by applicable law. We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.

We make every effort to display product colours, finishes, and details accurately, but we cannot guarantee that your device's display of any colour will be accurate.

Limitation of Liability

To the maximum extent permitted by applicable law, Meera Capsule Inc., its directors, officers, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of the Services or any products purchased through the Services.

Our total aggregate liability to you for any claim arising out of or related to these Terms or the Services will not exceed the amount you paid to Meera Capsule in the twelve (12) months preceding the event giving rise to the claim, or one hundred Canadian dollars (CAD $100), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent that applicable law in your jurisdiction does not permit such limitations, our liability is limited to the smallest extent permitted by law.

Indemnification

You agree to indemnify and hold Meera Capsule Inc., its directors, officers, employees, and affiliates harmless from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your violation of any law or third-party right, or your misuse of the Services.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.

Any dispute arising out of or related to these Terms or the Services will be resolved exclusively by the courts located in Toronto, Ontario, Canada, and you consent to the personal jurisdiction of such courts.

Nothing in these Terms restricts your right to bring a claim before any small claims tribunal or consumer-protection authority where applicable law permits.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent version. Material changes will be notified to account holders via email at least 30 days before they take effect. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.

Severability and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and any other policies posted on the Services, constitute the entire agreement between you and Meera Capsule Inc. regarding your use of the Services.
